Control and Implementation of Construction in Uzbekistan

Construction is one of the key elements of urban development activities aimed at ensuring sustainable territorial development, creating a safe and comfortable environment for the population, and implementing the state’s socio-economic programs. In Uzbekistan, control and implementation of construction are strictly regulated by the Urban Planning Code, which establishes the procedures for planning, designing, constructing, and operating facilities.

According to the Urban Planning Code of the Republic of Uzbekistan, construction of facilities is possible only on the basis of approved urban planning documents and in compliance with safety regulations, environmental requirements, and sanitary standards.

Key participants in the process:

  • Client – ensures project implementation, organizes expert review, monitoring, and financing;
  • Designer – develops urban planning documentation, provides design supervision;
  • Contractor – carries out construction, is responsible for quality and safety of works;
  • State authorities – monitor compliance with legislation, standards, and regulations.

State and Public Supervision

Construction control includes:

  • Technical supervision – carried out by the client to verify the quality of works;
  • Design (author’s) supervision – carried out by the designer to ensure compliance with project solutions;
  • State supervision – performed by specialized inspections under the Ministry of Construction and Housing & Communal Services, which have the right to suspend construction in case of violations;
  • Public supervision – exercised through participation of citizens’ self-government bodies, NGOs, and the media in discussing urban planning decisions.

Examination of Project Documentation

Particular importance is attached to expert review, which assesses compliance of project documentation with safety, sanitary, fire prevention, and environmental requirements. Without a positive expert conclusion, construction of most facilities is impossible. Exceptions include temporary, small-scale, and low-rise buildings.

Responsibilities in Construction

  • The client is responsible for organizing expert review, supervision, and eliminating identified defects.
  • The designer is liable for the correctness of design solutions and must suspend works if there is a threat to safety.
  • The contractor is responsible for the quality and final result, confirming it with a declaration of conformity.
  • State authorities are empowered to hold violators accountable, including fines, suspension, or demolition of unauthorized buildings.

Thus, control and implementation of construction in Uzbekistan represent a comprehensive system involving clients, designers, contractors, and state authorities. Mechanisms for Suspension and Termination of Construction

1. Grounds for suspension of construction

Construction may be temporarily halted by state authorities in cases of:

  • violations of urban planning legislation and building codes;
  • threats to life and health, or risk of accidents;
  • non-compliance of materials and technologies with standards, reducing building strength and reliability;
  • unauthorized construction without approved documentation.

Temporary suspension is also possible in emergencies, epidemics, or other threats to public safety, but not for more than ten working days without a court decision.

2. Full termination of construction

If violations are systemic or dangerous, state authorities may:

  • request through the court to stop construction works;
  • file a claim for demolition of unauthorized buildings;
  • annul construction permits.

3. Competent authorities

  • Ministry of Construction and Housing & Communal Services and its inspections – conduct supervision, issue orders to suspend works;
  • Local authorities – may restrict or prohibit construction in their territory, including demolition of illegal facilities by court decision;
  • Courts – issue final decisions on termination of construction or demolition of unauthorized buildings.

4. Responsibilities of participants

  • Contractors must correct violations and are liable for quality of works;
  • Clients are responsible for organizing expert review and supervision;
  • State authorities must ensure a balance of interests: citizen safety, environmental protection, and cultural heritage preservation.
