Clients may include state authorities, citizens’ self-government bodies, legal and natural persons, as well as entities operating in the form of public-private partnerships.

Main functions of the client:

  • organization of the development of urban planning documentation and selection of a designer;
  • conclusion of a contract with the contractor;
  • ensuring the examination of project documentation;
  • control over the quality of design and construction;
  • ensuring the elimination of identified defects within the warranty period.

Duties of the client:

  • comply with urban planning norms and rules;
  • prepare and approve design assignments;
  • provide designers with the necessary initial data (topographic materials, results of engineering and geological surveys, etc.);
  • organize author supervision and technical control over construction.

Thus, the client is the initiator and coordinator of the project, providing the legal and organizational conditions for its implementation.

Concept and role of contractors

Contractors may include legal entities holding a license, as well as individuals carrying out a limited scope of construction works (for example, construction of individual houses, utility structures, and small architectural forms).

Main functions of the contractor:

  • execution of construction, installation, and specialized works;
  • development and implementation of new structural solutions;
  • provision of workers with occupational safety equipment;
  • submission to the client of a declaration of compliance of completed works with project documentation and standards.

Duties of the contractor:

  • carry out construction strictly in accordance with the approved project documentation;
  • comply with urban planning norms, sanitary, and environmental requirements;
  • fulfill the lawful requirements of the client, designer, and state inspections;
  • ensure the quality and safety of constructed facilities;
  • bear responsibility for the final result and cost of works under the contract.

Thus, the contractor is the executor of urban planning solutions, putting the client’s concept into practice.

Relationship between clients and contractors

The relationship between the client and the contractor is based on the construction contract, which defines:

  • scope and timeline of works;
  • cost and payment procedure;
  • quality and safety requirements;
  • procedure for defect elimination and warranty obligations.

These relations are ensured by the principle of responsibility: the client is responsible for organization and control, while the contractor is responsible for execution and quality of works. Together they form a system of legal and economic regulation of the construction process.
