Urban Planning Documentation and Cadastre in Uzbekistan

← Previous Next →

Urban planning activities are a key instrument for the spatial development of territories and for ensuring a sustainable balance between the social, economic, and environmental interests of society. In Uzbekistan, they are regulated by the Urban Planning Code of the Republic of Uzbekistan, which defines concepts, principles, and the system of documentation, as well as establishes the state cadastre as the basis for recording and monitoring urban planning objects.

1. Concept and Role of Urban Planning Documentation

Urban planning documentation refers to approved documents that define the territorial development of settlements and their parts, as well as the conditions for construction and land use. According to the Code, such documents include:

  • Master plans of cities and towns;
  • Detailed planning projects;
  • Development projects for blocks and neighborhoods;
  • Documents on functional zoning of territories.

Functions of documentation:

  • Defining the directions of territorial development;
  • Establishing red lines and land-use boundaries;
  • Forming conditions for design, construction, and reconstruction of facilities;
  • Protecting public interests in development.

2. State Urban Planning Cadastre

The urban planning cadastre is a systematized set of data about territories, land use, construction sites, and infrastructure. It includes:

  • Information on land plots and their designated purposes;
  • Data on buildings and structures, their characteristics, and technical conditions;
  • Information on engineering and transport networks;
  • Zones for cultural heritage protection, sanitary zones, and protected areas.

The purpose of the cadastre:

  • Providing government authorities, legal entities, and individuals with reliable information;
  • Monitoring urban planning activities;
  • Controlling compliance with norms and rules of territorial use;
  • Serving as a basis for investment planning and land use.

3. Principles of Maintaining Documentation and Cadastre

Legislation establishes the following principles:

  • Consideration of the interests of the state, society, and citizens — balancing property rights with public needs;
  • Sustainable territorial development considering natural and man-made factors;
  • Openness and accessibility of information — data on norms and documentation must be published on official resources;
  • Environmental friendliness and safety — documentation must provide sanitary, fire-safety, and seismic standards;
  • Integration with international practice — use of foreign regulatory and technical documents adapted to the conditions of Uzbekistan is permitted.

4. Link Between Documentation and Cadastre

Urban planning documentation and the cadastre are interconnected:

  • Documentation defines rules and boundaries of land use;
  • The cadastre records and stores information about the actual state of the territory;
  • Together, they ensure monitoring, examination, and control of urban planning activities.

5. Practical Significance

  • For the state — formation of spatial development strategies, control over land use, protection of cultural heritage.
  • For society — guaranteeing a comfortable urban environment, access to public spaces and infrastructure.
  • For business and investors — clarity of construction rules, reduced risks in implementing investment projects.

Records the current state of objects

Urban planning documentation and cadastre are complementary tools of state territorial development management. They enable a transparent, sustainable, and legally regulated construction system, balancing the interests of the state, society, and the private sector. For Uzbekistan, their development is particularly relevant amid urbanization, infrastructure modernization, and investment attraction.

Conclusion:

  • Documentation is a planning tool that sets future development.
  • The cadastre is a recording tool that captures the current state of objects and territories.
  • Together, they form a system of spatial development management: documentation projects, the cadastre records, and government authorities oversee implementation.

Procedure for Developing, Approving, and Updating Urban Planning Documentation

The Urban Planning Code of the Republic of Uzbekistan sets out a detailed procedure for preparing, approving, and implementing urban planning documentation.

  1. Initiation and Development
    • Customers (state bodies, self-governing bodies, legal and natural persons) prepare the assignment and sign a contract with licensed developers.
    • Developers prepare documents: master plans, detailed planning projects, construction projects, FS, land use rules, etc.
  2. Coordination
    • Materials must be coordinated with all relevant bodies and organizations, including environmental, sanitary, and fire-safety authorities.
    • Requirements for cultural heritage protection and engineering infrastructure must also be considered.
    • Developers are obliged to ensure coordination before expert review.
  3. Expert Review
    • All urban planning documents undergo mandatory review for compliance with standards and rules.
    • Review is conducted by specialized state bodies, expert commissions, or accredited entities.
    • Checks cover:
      • Compliance with urban planning, sanitary, and environmental norms;
      • Fire and seismic safety;
      • Energy efficiency of project solutions.
  4. Approval
    • Approval level depends on project importance:
      • The Cabinet of Ministers approves master plans of Tashkent, Nukus, regional centers, and national planning schemes.
      • Local authorities approve plans and projects of districts, towns, and rural settlements.
    • Once approved, documentation becomes binding and serves as the legal basis for issuing construction permits.
  5. Adjustment and Updating
    • If socio-economic conditions change or inconsistencies are revealed, documentation must be adjusted.
    • Amendments go through the same procedure of coordination, review, and approval.
    • Adjustments are mandatory if construction parameters change (e.g., increased height or density).

Thus, the process can be summarized as a sequence: Development → Coordination → Expert Review → Approval → Implementation → Monitoring and Adjustment.
