Permit for Hydrocarbon Extraction: Legal and Practical Aspects

Hydrocarbon extraction in the Republic of Uzbekistan is regulated by a set of rules enshrined in the Law "On Subsoil" (ZRU-987 of 31.10.2024). The permit for hydrocarbon extraction is a key legal instrument granting the subsoil user the right to carry out the full range of activities related to the extraction and processing of oil and gas. This article examines the legal nature of the permit, the conditions for obtaining it, the rights and obligations of subsoil users, and state supervision.

A permit for hydrocarbon extraction is an official document issued by the competent authority certifying the right to use a specific subsoil plot for the development of oil and gas fields or individual hydrocarbon deposits. The document defines the boundaries of the site, the term of validity, and the conditions of operation.

Conditions for Obtaining the Permit

To obtain a permit, it is necessary to:

  • Have a confirmed commercial discovery of hydrocarbons or geological study results proving the feasibility of industrial production.
  • Prepare and approve a field development project, including technical, environmental, and economic justifications.
  • Undergo mandatory environmental review in accordance with the Law "On Environmental Expertise."
  • Pay the established fees and charges.
  • Comply with good oil and gas industry practices.

Scope of Activities Permitted

The works authorized under the permit include:

  • Development of oil and gas fields.
  • Extraction, transportation, preparation, and separation of hydrocarbons.
  • Construction, installation, operation, and maintenance of oil and gas infrastructure facilities.
  • Use of technologies and methods ensuring rational subsoil use and environmental protection.

Rights and Obligations of the Subsoil User

Rights:

  • Extract and dispose of hydrocarbons within the limits established by the permit.
  • Transfer the permit rights (sale, pledge, etc.) in accordance with the law.
  • Use auxiliary infrastructure.

Obligations:

  • Comply with the terms of the permit and project documentation.
  • Ensure industrial and environmental safety.
  • Keep records of production and submit reports to authorized bodies.
  • Fulfill obligations to eliminate the consequences of subsoil use.

State Supervision

Supervision over compliance with the permit conditions is carried out by:

  • The Ministry of Energy – in terms of policy in the hydrocarbon sector.
  • The Inspectorate for Control in the Mining Industry and Geology – on industrial safety issues.
  • The Ministry of Ecology – on environmental protection.
  • The Subsoil Use Center – for accounting, issuing, and suspending permits.

Termination and Suspension of the Permit

The permit may be revoked or suspended in cases of:

  • Violation of environmental requirements.
  • Non-compliance with industrial safety conditions.
  • Failure to carry out works within the prescribed time.
  • Discovery of illegal extraction activities.

In certain cases, joint development of hydrocarbons is allowed if the deposits are located within the boundaries of several permits, subject to the conclusion of an appropriate agreement between the subsoil users.

A permit for hydrocarbon extraction is not only the legal basis for conducting oil and gas activities but also an instrument for ensuring rational and safe use of national resources. Effective implementation of this mechanism requires strict compliance with legislation, technical standards, and environmental requirements. With Uzbekistan’s growing energy demand, the role of the permit system will only increase, ensuring a balance between the interests of the state, investors, and society.
