Consequences and Liability for Lack of Expert Examination
The Urban Planning Code of the Republic of Uzbekistan directly provides that expertise is the basis for approval and implementation of a project. If project documentation has not undergone mandatory examination, it cannot be agreed or approved. Consequently, construction under such a project is considered illegal.
The absence of an expert opinion makes it impossible to obtain a permit for construction or reconstruction. Even if the facility has been built, it cannot be commissioned without a positive expert opinion. If a facility is operated without expertise, the authorized bodies may require its conservation or demolition.
